By accessing and using the GhostDraw website and purchasing our products, you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use our services.

2. Age Requirement and Verification

You must be at least 21 years of age to purchase products from GhostDraw. By making a purchase, you affirm that:

  • You are 21 years of age or older
  • You have the legal right to purchase these products in your jurisdiction
  • You will provide valid identification upon delivery if requested
  • Adult signature is required for all deliveries

3. Product Description and Limitations

IMPORTANT: GhostDraw sells vaporizer hardware devices only. Our products:

  • Are sold as hardware-only devices without any included consumables
  • Do not include pods, cartridges, or e-liquid of any kind
  • Require users to separately purchase compatible pods/e-liquid from third-party retailers
  • Are designed to work with standard compatible pods (e.g., Juul-compatible)
  • Give users complete freedom to choose their preferred pods and substances

4. User Responsibilities and Disclaimers

By purchasing our hardware, you acknowledge and agree that:

  • You are solely responsible for purchasing and using compatible pods/e-liquid
  • GhostDraw is not responsible for the quality, safety, or legality of any third-party pods or e-liquid you choose to use
  • You will comply with all local, state, and federal laws regarding vaporizer use
  • You understand the device is intended for adult use only
  • You will not resell the device to minors

5. Health and Safety Disclaimers

FDA Disclaimer: These statements and products have not been evaluated by the Food and Drug Administration. Our products are not intended to diagnose, treat, cure, or prevent any disease.

Battery Safety: Users must follow all battery safety guidelines provided with the device, including using only the provided charging cable and avoiding exposure to extreme temperatures.

6. PACT Act Compliance

Our hardware-only devices (not pre-filled with liquid) are not subject to PA-2 reporting requirements under the PACT Act. However:

  • Adult signature is required on delivery
  • Age verification is performed at purchase
  • We ship only via carriers that support adult signature verification
  • We comply with all applicable shipping regulations

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • GhostDraw's liability is limited to the purchase price of the product
  • We are not liable for any indirect, incidental, special, or consequential damages
  • We are not liable for damages arising from the use of third-party pods or e-liquid
  • We are not liable for any health effects resulting from product use
  • Our warranty covers manufacturing defects only, not misuse or damage from third-party products

8. Indemnification

You agree to indemnify and hold harmless GhostDraw, its officers, directors, employees, and agents from any claims, damages, or expenses arising from:

  • Your use of the device with third-party pods or e-liquid
  • Your violation of these terms
  • Your violation of any applicable laws
  • Any misrepresentation of your age or eligibility

9. Warranty

GhostDraw provides a 1-year limited warranty on hardware manufacturing defects. This warranty:

  • Covers manufacturing defects in materials and workmanship
  • Does not cover damage from misuse, unauthorized charging, or third-party products
  • Does not cover normal wear and tear
  • Requires proof of purchase and return of the defective device
  • Is limited to repair or replacement at our discretion

10. Governing Law and Arbitration

These terms are governed by the laws of [State], without regard to conflict of law principles. Any disputes arising from these terms or your use of our products shall be resolved through binding arbitration rather than in court, except for injunctive relief.

11. Returns and Refunds

Due to the nature of vaporizer hardware and health regulations:

  • Returns are accepted within 30 days for unopened, unused products only
  • Refunds are subject to a 15% restocking fee
  • Customer is responsible for return shipping costs
  • Products must be in original packaging with all accessories
  • No returns accepted for used or damaged devices

GhostDraw reserves the right to modify these terms at any time. Changes will be posted on this page with an updated "Last updated" date. Continued use of our services after changes constitutes acceptance of the new terms.
